With the whole crew gathered around a computer monitor, we just watched Superior Court Judge John Einhorn read a guilty verdict for most of the charges against Seth Cravens, including 2nd degree murder, after he killed Emery Kauanui in a fight outside of Kauanui’s house in the upscale neighborhood of La Jolla, California. After the verdict was read, Cravens, who was shaking his head, muttered “I’m not ready to go” but was nonetheless handcuffed by bailiffs and led back to jail where he will await sentencing scheduled for January 12, 2009.
The guilty verdict brings to an end the sensational and emotional trial that began when Cravens and his crew—the Bird Rock Bandits—confronted Emery Kauanui outside of his house after a previous altercation at a nearby bar. SAN DIEGO – A San Diego Superior Court jury found Seth Cravens guilty of second-degree murder Tuesday in the fatal beating last year of a professional surfer in La Jolla.
Sentencing was set for Jan. 12. Cravens’ defense lawyer said they would appeal the verdict.
Prosecutors had contended that Cravens, 22, was one of a group of five men who attacked Emery Kauanui, 24, on May 24, 2007, outside Kauanui’s mother’s home.
Cravens’ attorney, Mary Ellen Attridge, had told jurors that her client acted in self-defense. Prosecutors contended that the only person who acted in self-defense was Kauanui, who suffered a skull fracture and died in the hospital four days later.
The five men, all graduates of La Jolla High School, were called the Bird Rock Bandits and had engaged in many alcohol-fueled fights in the neighborhood over several years, prosecutors said during the trial.
Jurors were instructed to consider lesser offenses of voluntary and involuntary manslaughter if Cravens was acquited of second-degree murder, which carries a possible prison sentence of 15 years to life.
Jurors began deliberating the case on Nov. 10 after a two-week trial. The court was closed on Tuesday for Veterans Day. The panel of nine men and three women deliberated full days on Wednesday and Thursday.
For a time Monday, the jury was split 11-1. Whether the jury was leaning toward conviction or acquittal at that point was not disclosed at that time.
According to testimony, Cravens and four others – Eric House, Matthew Yanke, Orlando Osuna and Henri “Hank” Hendricks – left a La Jolla bar where House and Kauanui had gotten into an altercation.
The men drove to Kauanui’s mother’s home on Draper Avenue in La Jolla, where the fight broke out. At one point during the skirmish, Kauanui rose to his feet after being on the ground, according to testimony. He argued with Cravens, who witnesses said hit Kauanui once in the jaw, knocking him to the ground.
Yanke, House and Osuna pleaded guilty in June to involuntary manslaughter. House and Yanke were ordered to serve 210 days each in county jail. Osuna received the longest jail term at 349 days.

I am apalled at the jury’s second degree murder conviction. It appears to me, that all these young men were as guilty as Seth Cravens. The difference between him and the other three, attackers, was merely money. Their father’s had money to bail them out and Seth Cravens, whose parents apparently did not have money to bail him out, was left to take all the blame. I am sorry for the death of Emery Kaunani, but from what I have read and observed, all these men were drinking and fighting as was their usual way of operating.
Perhaps all the young men who have written their delight on the conviction, should examine their own hearts and wonder if any of them could be in this situation.
Perhaps mercy is the word we should be using, instead of hip hip hooray.

the other difference was that he thought he could beat the wrap so he decided not to plead out. He’s an idiot and finally got what he had coming to him. that said, it’s hard to let Emery off the hook here - he certainly didn’t deserve to die, but he wasn’t any smarter than the rest of ‘em.

What are you talking about Kathleen? The others who were charged were not charged with murder, because they didn’t murder Emery. They took plea deals. They weren’t bailed out, they served time for their crimes. Seth chose not to take the plea deal, he had his chance.
Do you understand that Seth was charged with 11 other crimes? You understand that he sucker punches people all the time. Read the police report? This is not an isolated incident. You ask us guys to see if we can empathize with Seth. No I can’t, I won’t sucker punch someone who is way smaller then I am.

Maybe there is incest in the family, and molestation as a youth was the cause of Seth’s obvious anger issues? Sexual abuse as a child can lead to feelings of failure, depression, and often lead to rage. Obvious Seth was molested or taken advantage of sexually as a child by an uncle, father, friend, or brother in law.

He’s done for. Even if he bothers making appeals to the appellate courts they’ll most likely deny his motions. If he’s somehow lucky enough to get a retrial, it could take years for it to go through. Either way he’s going to enjoy bonding with the boys in the big house over cigarettes and anal sex. did you ever look at Emery’s past; he was going to be arrested for breaking his parole, he beat up a guy in Florida, he strangled held another in Oceanside, he called the guys on his cell phone to come over and fight; all recorded Emery wanted that fight; they did not call him, he called them to come
He was into heavy drugs, he came out of his condo willingly and beat up Eric House to a pulp, he came up the Seth and started to call him names

It seems to me like the new school surfing community (not the pro’s, we have already proven ourselves) is full of mean and aggressive close minded clicky wanna be spiritualists with no real direction and a narrow scope on the world in general. From what I can gather, most are just beer acoholics that bully visitors on “their beach”. My scene is always welcoming to outsiders; , we love to see someone begin there adventure. It’s a shame because from a distance, surfing looks very organic and beautiful, but there are a lot of douche idiots that have ruined that dipiciton. How sad it is for a young man to have bullied the community and had gotten away from it for so long. I commend all those who took courage to testify of his wrong doings, it wasnt easy but you have spared many innocent people the trauma of this out-of-control brat. Shame on his parents who are in denial of his manipulative acts. Seth’s unemotional apology was prideful and disgusting just as his attorney’s bad conduct performance. Her aggression gives off a bad persona for all good lawyers with respect and integrity for life. In the end Seth and his attorney deserves a “guilty” plea.

I made an offer to Seth's parents a year ago: put up the bail money to spring your psychotic coward of a son out of jail, send him up to L.A. where I've booked 30 minutes in a karate studio, and I'll kick the living s—- out of him. The invitation e-mail was sent to all the San Diego papers, from the Union Tribune to the local rags in La Jolla & elsewhere.
Never heard back. I'm now upping the ante to include his scumbag brother-in-law, Vic. I would be most happy to perform a civic favor for local law enforcement & La Jolla's city council by removing both of these cretins, permanently, so they will no longer be a threat to decent, law abiding citizens who live and work in your community.
